Terms of Service

By using Kept, you agree to these terms. Please read them carefully.

Your Account

You must be at least 13 years old to use Kept. You are responsible for maintaining the security of your account and for all activity that occurs under it. One person or legal entity may not maintain more than one account.

Your Content

You retain full ownership of all photos, text, and other content you upload to Kept. By uploading content, you grant us a limited license to store, display, and transmit your content solely for the purpose of operating the Kept service. We will never use your content for advertising, AI training, or any purpose beyond providing the service to you.

Creating Timelines for Others

Kept allows you to create timelines for children, pets, and memorials for deceased individuals. When creating a timeline for another person:

• You must have a legitimate relationship with the person (parent, family member, close friend)
• For memorials, you must have the consent of the family or be acting in good faith to honor the deceased
• You may not create timelines to harass, impersonate, or misrepresent any person
• Content that is defamatory, fraudulent, or violates another person's rights will be removed

Collaboration

When you invite someone to collaborate on a timeline, you grant them the ability to add photos and milestones to that timeline. You remain the owner and can remove collaborators or their contributions at any time. Collaborators may not delete or modify content they did not create.

Memorial Timelines

Memorial timelines may be shared publicly via a web link. As the memorial creator, you are responsible for moderating contributions. We reserve the right to remove memorial content that violates these terms or is reported as inappropriate. Memorial web pages are hosted at thekept.app and remain accessible as long as the creator's account is active.

Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or violates any person's rights
• Use the service to harass, stalk, or intimidate others
• Upload content you do not have the right to share
• Attempt to access other users' accounts or data
• Use automated systems to access the service
• Interfere with the operation of the service

Storage and Availability

We strive to keep your data safe and the service available, but we cannot guarantee 100% uptime or zero data loss. We strongly recommend keeping local copies of important photos. We are not liable for any loss of data due to service interruptions, technical failures, or account deletion.

Termination

You may delete your account at any time from within the app. We may terminate or suspend your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

Disclaimer of Warranties

Kept is provided “as is” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, Kept and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Governing Law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law provisions.

Changes to These Terms

We may update these terms from time to time. Significant changes will be communicated through the app. Continued use of Kept after changes constitutes acceptance of the updated terms.
